EVICTION HEARINGS TO RESUME SEPTEMBER 7

The Virginia Supreme Court has ordered that all eviction matters including those for non-payment of rent will be heard in appropriate courts after September 7th.

BEGINNING IN MARCH 2020 AND RECONFIRMED AS LATE AS AUGUST 7, 2020, VIRGINIA COURTS HAVE BEEN THE SUBJECT OF A JUDICIAL EMERGENCY DECLARED PURSUANT TO Va. Code Section 17.1-330. THE PURPOSE OF THIS ADVISEMENT IS TO PROVIDE CURRENT INFORMATION FROM THE VIRGINIA SUPREME COURT REGARDING RESIDENTIAL EVICTIONS AND CIVIL PROCESS RELATING TO SUCH ACTIONS.

Q. Did the Supreme Court issue a new order regarding Evictions that takes effect August 10th?
A. Yes, the Order issued Friday covers the period of time from August 10th until September 7th

Q. What does the Order state regarding Evictions and Unlawful Detainers?
A. Starting Monday August 10th no new Writs of Eviction can be issued by any Court except for those that do NOT involve non-payment of rent.

Q. What about Writs of Eviction issued prior to August 10th?
A. They may be served and executed upon, however, tenants may be advised to have their counsel or they can ask  the court for a stay of execution based on the Order of August 7th.
